1) Overview
Welcome to Nightlife Thailand (“we,” “us,” “our”). We operate a nightlife directory and content platform located at nightlifethailand.com (the “Site”). By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.
These Terms form a binding agreement between you and Nightlife Thailand and incorporate our Privacy Policy (covering the Thai Personal Data Protection Act, B.E. 2562 (2019) – PDPA).
2) Eligibility & Age Restriction
You must be at least 20 years old (Thailand’s legal drinking age) to use features related to nightlife venues, alcohol, events, or promotions. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3) Services We Provide
We publish listings, maps, editorial content, and user reviews about nightlife and entertainment venues (bars, clubs, rooftops, events, etc.) across Thailand. We may provide links to third-party services (e.g., venue websites, reservation systems, ticketing platforms) and display third-party maps and embeds.
We may change, suspend, or discontinue any feature at any time without notice.
4) Accounts & User Responsibilities
Some features may require you to create an account. You agree to:
- Provide accurate, current information;
Keep your login details secure;
Be responsible for all activity under your account.
- We may refuse, suspend, or terminate accounts if we suspect rule violations or unlawful activity.
5) User-Generated Content (UGC)
You may submit ratings, reviews, photos, or other content (“UGC”). You confirm that:
You own or have the rights to your UGC;
Your UGC is accurate and not misleading;
Your UGC does not violate any third-party rights (including copyright, trademark, privacy, publicity), defame anyone, or promote illegal activity.
By posting UGC, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, and display your UGC in connection with the Site, our social channels, emails, and promotional materials.
We may moderate, edit, or remove UGC at our discretion, but we are not obligated to do so. We do not endorse UGC and are not responsible for it.
6) Acceptable Use
You agree not to:
Use the Site for unlawful, harmful, or fraudulent purposes;
Post or transmit spam, malware, or automated scraping/crawling that degrades performance;
Interfere with security-related features or attempt to reverse engineer the Site;
Misrepresent your identity, impersonate others, or post paid/compensated reviews without disclosure;
Publish personal data of others without consent.
We may use automated and manual tools to detect and address violations.
7) Venue Listings & Accuracy
We strive to keep listings accurate and up to date, but hours, prices, menus, policies (including entry fees/age/ID), dress codes, and events may change without notice. Always confirm details directly with the venue before attending. We do not control third-party venues and are not responsible for their operations, safety, or compliance with law.
Venues may request edits or removal of their pages by contacting us (see below for more information).
8) Safety & Personal Responsibility
Nightlife involves inherent risks (e.g., alcohol consumption, late-night travel, crowding). You are solely responsible for your decisions and conduct. Consider personal safety, local laws, transportation options, and health factors. We do not provide transportation, security, or supervision, and we are not responsible for incidents that occur at or around venues.
9) Third-Party Services, Links & Maps
The Site may link to or embed third-party services (e.g., Google Maps, booking platforms, social media, ticketing). Those services are governed by their own terms and privacy policies. We do not endorse or control these services and are not liable for their content, policies, outages, or actions.
10) Affiliate Links & Advertising
We may include affiliate links or paid placements. If you click or buy through those links, we may earn a commission at no extra cost to you.
11) Intellectual Property
Except for UGC, all content on the Site—text, graphics, logos, photos, videos, design elements, and software—is owned by or licensed to us or is owned by its respective copyright owners and protected by applicable laws. You may not copy, reproduce, distribute, modify, or create derivative works without prior written consent.
12) Copyright & Takedown Requests
If you believe content on the Site infringes your rights, please email contact@nightlifethailand.com with: (a) your contact details; (b) identification of the work you claim is infringed; (c) the URL of the allegedly infringing content; (d) a statement of good-faith belief; and (e) a statement that the information is accurate and that you are the rights holder or authorized to act on their behalf.
13) Privacy & PDPA
Our collection and use of personal data is described in our Privacy Policy, which complies with Thailand’s PDPA to the extent applicable. By using the Site, you consent to data practices described there. You may have rights of access, correction, and deletion under PDPA—see the Privacy Policy or contact us (Section 16).
14) Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted or error-free operation, accuracy, or completeness of information.
15) Limitation of Liability
To the maximum extent permitted by law, Nightlife Thailand and our owners, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages; lost profits; lost data; personal injury; property damage; or other losses arising out of or related to your use of the Site, even if we were advised of the possibility of such damages.

19) Governing Law & Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Bangkok, Thailand. If you are a consumer with mandatory rights under local law, this clause does not deprive you of those rights.
20) Miscellaneous
Entire Agreement: These Terms and our Privacy Policy are the entire agreement between you and us regarding the Site.
Severability: If any provision is unenforceable, the remainder remains in effect.
No Waiver: Failure to enforce a provision is not a waiver.
Assignment: You may not assign your rights or obligations under these Terms; we may assign ours in connection with a merger, acquisition, or asset sale.
